Arbitration

To the fullest extent permitted by law, any dispute, controversy, or claim of any kind arising out of or relating in any way to your purchase, use, or possession of MagicTag Engineering markers — including but not limited to product performance, durability, safety, or marketing representations — shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

  • The arbitration shall take place in Cheyenne, Wyoming, USA, before a single arbitrator.
  • The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.
  • Each party shall bear its own costs and attorney’s fees, unless otherwise determined by the arbitrator.
  • By purchasing or using MagicTag Engineering markers, you waive any right to pursue claims in court or through a class action, except as may be required by law for provisional remedies in aid of arbitration.

Governing Law

This Agreement shall be governed by the laws of Wyoming, USA, without regard to conflict of law provisions. Any disputes not subject to arbitration, or matters related to the enforcement of arbitration awards, shall be subject to the exclusive jurisdiction of the state and federal courts of Wyoming, and you consent to such jurisdiction.

Modification of Agreement

MagicTag Engineering may revise these terms at any time by updating this page. You are bound by any such revisions.
